   These Terms and Conditions ("Terms") govern your access to and use of the Presto VPN iOS application and related services (together, "Presto VPN", the "App", or the "Service"), operated by Esinti Yazılım Teknoloji ve Giyim San. Tic. Ltd. Şti ("Esinti", "we", "us", or "our").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the App.

Please also read our Privacy Policy, which explains how we handle data in connection with the App and forms part of these Terms by reference.

• "App" means the Presto VPN application for iOS, including all updates, upgrades, and related documentation.
• "Service" means the virtual private network ("VPN") functionality and any related features provided through the App.
• "Subscription" means a paid, auto-renewable plan that unlocks premium features of the App.
• "Free Tier" means use of the App without a paid Subscription, which may include advertising and feature limitations.
• "Device" means the iOS device on which you install and use the App.
• "You" or "User" means the individual using the App.

The App is intended for users aged 18 and over. By using the App, you represent and warrant that you are at least 18 years old and that you have the legal capacity to enter into these Terms. We do not knowingly permit anyone under the age of 18 to use the App.

Presto VPN is a VPN application that establishes an encrypted connection between your Device and our servers, routing your internet traffic through those servers. The Service is intended to support online privacy and to help you access internet content and communication services.

The App is provided under a freemium model:

• A Free Tier that may include advertising and certain feature or usage limitations; and
• One or more paid Subscriptions that unlock premium features.

You acknowledge and agree that:

• The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times or in all locations.
• Network operators, governments, or other third parties in certain countries may actively detect, throttle, restrict, or block VPN traffic. We do not guarantee that the Service will function, connect, or remain available in any particular country, on any particular network, or at any particular time.
• The Service is not designed or guaranteed to provide access to streaming platforms or other services that detect and block VPN connections, and such access is not part of what we offer.
• Individual VPN sessions are automatically terminated after a maximum of 24 hours, after which you may reconnect.

We may add, modify, suspend, or discontinue any part of the Service at any time, with or without notice.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on iOS devices that you own or control, solely for your personal, non-commercial use, and as permitted by the Apple App Store Terms of Service and the Usage Rules set out therein.

You may not:

• copy, modify, adapt, translate, reverse engineer, decompile, or disassemble the App, except to the extent expressly permitted by applicable law;
• rent, lease, lend, sell, redistribute, sublicense, or otherwise commercially exploit the App or the Service;
• remove, obscure, or alter any proprietary notices in the App; or
• use the App or Service other than as expressly permitted by these Terms.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to, and must not permit any third party to use the Service to:

• engage in, facilitate, or promote any activity that is illegal under any law applicable to you;
• gain or attempt to gain unauthorized access to any system, network, account, or data; conduct port scanning, penetration testing, denial-of-service or distributed denial-of-service attacks, or any other network attack;
• transmit, distribute, or store malware, viruses, worms, or any malicious or harmful code;
• send spam, bulk unsolicited messages, or engage in phishing or other deceptive practices;
• infringe the intellectual property rights of others, including by distributing or downloading pirated or counterfeit material;
• produce, store, distribute, or access child sexual abuse material or any content that sexualizes or exploits minors;
• harass, threaten, defame, or harm any other person, or violate the privacy or rights of others;
• engage in fraud, money laundering, or the financing of illegal activity;
• resell, sublicense, or share access to the Service, or operate the Service on behalf of third parties;
• attempt to circumvent usage limits, security controls, or restrictions of the App or the Free Tier, or interfere with or disrupt the integrity or performance of our servers or network.

We reserve the right to investigate suspected violations and to suspend or terminate access to the Service for any User who, in our reasonable judgment, violates this Acceptable Use Policy, without limiting any other remedies available to us.

Premium features are offered through auto-renewable Subscriptions, which are purchased and managed through your Apple App Store account. The following terms apply:

• Pricing. The price, billing period, and features of each Subscription are displayed in the App and on the App Store at the point of purchase. Prices may vary by region and may change from time to time; any price change will apply only to billing periods after the change, and where required, with prior notice.
• Payment. Payment is charged to your Apple ID account upon confirmation of purchase.
• Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price, unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
• Managing and cancelling. You can manage or cancel your Subscription at any time through your Apple ID account settings (Settings > [your name] > Subscriptions). Cancellation takes effect at the end of the current billing period; you will retain access to premium features until then.
• Free trials and introductory offers. Where a free trial or introductory offer is provided, any unused portion is forfeited when you purchase a Subscription, where applicable. If you do not cancel before the trial ends, the Subscription will begin and your Apple ID account will be charged.
• Refunds. Purchases are processed by Apple. Refund requests are handled by Apple in accordance with the App Store terms and applicable law. We do not directly process payments and generally cannot issue refunds for App Store purchases.

The Free Tier of the App is supported by advertising provided through third-party advertising services, including Google AdMob. By using the Free Tier, you acknowledge that advertisements may be displayed within the App. The collection and use of data in connection with advertising are described in our Privacy Policy.

Your use of the App is also governed by our Privacy Policy, which explains what data we and our service providers process, including our approach to logging. We do not log your online activity, such as the websites you visit, your DNS queries, or the content of your traffic. We do retain limited connection records (such as which server you connect to and when) for a limited period for security and abuse-prevention purposes, as described in the Privacy Policy.

VPN technology is regulated, restricted, or prohibited in some countries and jurisdictions, and the legality of using a VPN — and of accessing particular content or services through a VPN — varies by location.

You are solely responsible for ensuring that your use of the App and the Service is lawful in your jurisdiction and complies with all applicable laws, regulations, and the terms of any network you use. You use the Service at your own risk. We do not provide legal advice, and nothing in the App or these Terms should be interpreted as a representation that your use of the Service is lawful in any particular jurisdiction.

To the maximum extent permitted by law, we are not responsible or liable for any consequence arising from your use of the Service in violation of any law, regulation, or third-party terms applicable to you.

The App, the Service, and all related content, software, designs, trademarks, logos, and other materials are owned by Esinti or its licensors and are protected by intellectual property and other laws. Except for the limited license granted in these Terms, no rights are granted to you. "Presto", "Presto VPN", and related names and logos are trademarks or trade names of Esinti and may not be used without our prior written permission.

The Service allows you to access content, websites, and services operated by third parties. We do not control and are not responsible for any third-party content, websites, or services accessed through the Service, and we make no representations regarding their availability, accuracy, legality, or safety. Your use of any third-party content or service is at your own risk and may be subject to that third party's own terms.

The App also incorporates third-party software and services (including, for example, Apple, Google/Firebase, Google AdMob, AppsFlyer, and Adapty), whose terms and privacy practices apply to their respective components, as described in our Privacy Policy.

To the maximum extent permitted by applicable law, the App and the Service are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting the foregoing, we do not warrant that:

• the Service will be uninterrupted, secure, timely, or error-free;
• the Service will connect or function in any particular country, on any particular network, or at any particular time;
• any defects will be corrected; or
• the Service will meet your requirements or expectations.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

To the maximum extent permitted by applicable law:

• in no event will Esinti, its directors, employees, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of, or inability to use, the App or the Service; and
• our total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the total amount you paid to us (or through the App Store for the App) in the 12 months preceding the event giving rise to the liability, or (b) the equivalent of USD 50.

Some jurisdictions do not allow the limitation or exclusion of certain liability, so some of the above limitations may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Esinti and its directors, employees, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your violation of any law or the rights of any third party, or your misuse of the Service.

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe that you have violated these Terms (including the Acceptable Use Policy) or applicable law, or to protect the security or integrity of the Service.

Because the App does not require you to create an account, you may end these Terms at any time by ceasing to use the Service and uninstalling the App. Cancelling a Subscription is handled through your Apple ID account settings as described in Section 6.

Provisions that by their nature should survive termination (including those relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive termination of these Terms.

We may modify the Service and these Terms from time to time. Where changes are material, we will take reasonable steps to notify you, for example through the App or by updating the "last updated" date below. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.

These Terms are between you and Esinti only, and not with Apple Inc. ("Apple"). The following additional terms apply with respect to your use of the App obtained from the Apple App Store:

• Apple has no obligation to furnish any maintenance or support services with respect to the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the applicable purchase price (if any) to you; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
• In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Esinti, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim, to the extent required by these Terms.
• You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms of agreement when using the App.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict-of-law rules. Subject to any mandatory consumer protection rights you may have under the laws of your country of residence, the courts of Istanbul, Türkiye will have jurisdiction over any dispute arising out of or relating to these Terms or the Service.

• Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Esinti regarding the App and the Service.
• Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
• No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment. You may not assign or transfer these Terms. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
