These Terms and Conditions ("Terms") govern your use of the Presto VPN app for iPhone and iPad and the VPN service provided through it (together, "Presto VPN", the "App" or the "Service"). The Service is operated by Esinti Yazılım Teknoloji ve Giyim Sanayi Ticaret Limited Şirketi ("Esinti", "we", "us" or "our").

By downloading, installing or using the App, you agree to these Terms. If you do not agree, do not download, install or use the App.

Our Privacy Policy explains how we handle personal data and forms part of these Terms.

1. Definitions

"App" means the Presto VPN application for iPhone and iPad, including all updates.
"Service" means the virtual private network ("VPN") service and the related features provided through the App.
"Account" means the anonymous account the App creates for you automatically, linked to a device identifier. No name, email address or password is required.
"Free Version" means using the App without a paid Subscription. It is supported by advertising and has usage limits.
"Premium" and "Subscription" mean a paid, auto-renewing plan that removes the Free Version's ads and limits.
"Device" means the iPhone or iPad on which you use the App.
"You" means the individual using the App.

2. Eligibility

You must be at least 18 years old and able to enter into a binding agreement to use the App. By using the App, you confirm that you meet these requirements.

3. The Service

Presto VPN creates an encrypted connection between your Device and our servers and routes your internet traffic through them. It is intended to protect your connection on untrusted networks and support your online privacy.

To provide the Service:

Server and protocol selection. The App can choose a server and a VPN protocol for you, and may switch between protocols or servers to keep you connected. The protocols, servers and locations we offer may change at any time.
Automatic reconnection. The App may set up iOS "Connect On Demand" so that the VPN reconnects automatically. You can disconnect in the App, and manage this setting in iOS Settings > VPN.
Session length. A single VPN session ends automatically after at most 24 hours. You can reconnect right away.
Local network. Traffic to your local network (for example, printers or other devices on your home Wi-Fi) may not be routed through the VPN.

You acknowledge that:

the Service is provided "as is" and "as available", and we do not guarantee that it will be uninterrupted, error-free or available at all times, in all locations or on all networks;
network operators, governments or other parties may detect, slow down or block VPN traffic, and we do not guarantee that the Service will work in any particular country, on any particular network or at any particular time;
while the App is connecting, reconnecting or switching servers, and if the connection drops, some traffic may briefly travel outside the VPN;
a VPN does not make you anonymous. It does not protect you from malware, phishing or tracking by the websites and services you sign in to, and it does not prevent those services from identifying you by other means;
websites and services may locate you differently from the server location you chose, and the Service is not designed or guaranteed to give access to streaming platforms or other services that restrict VPN connections; and
connection speeds depend on many factors outside our control, and we do not guarantee any particular speed.

We may add, change, suspend or discontinue any part of the Service at any time.

4. Your Account

The App creates an anonymous Account automatically the first time you open it. The Account is linked to a device identifier stored on your Device, and Premium is linked to the Apple ID used for the purchase. You can restore a Subscription on another Device signed in to the same Apple ID through the App's restore option.

You are responsible for your Device and for how the App is used on it. If you want us to delete your Account and its data, follow the instructions in our Privacy Policy.

5. Free Version and Premium

Free Version. The Free Version is supported by ads, including banner, full-screen and rewarded ads. It offers time-limited VPN sessions, which you can extend by watching rewarded ads where this option is available, and access to a limited set of server locations. We may change the Free Version's time limits, available servers, speeds, ad formats and rewards at any time.

Premium. Premium removes ads and the Free Version's time limits, gives access to all available server locations and includes extra features such as the speed test. The features of each plan are described in the App at the point of purchase.

6. Subscriptions and Payments

Premium is offered through auto-renewing Subscriptions purchased and managed through your Apple ID.

Plans and prices. The available plans (for example weekly, monthly, quarterly or yearly), their prices and any free trial or introductory offer are shown in the App before you buy. Prices vary by country and may change. Price changes apply from your next billing period, and Apple notifies you where required.
Payment. Payment is charged to your Apple ID account when you confirm the purchase.
Auto-renewal. A Subscription renews automatically at the end of each period at the then-current price unless you turn off auto-renewal at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within the 24 hours before the current period ends.
Free trials. If you do not cancel at least 24 hours before a free trial ends, the Subscription starts and your Apple ID account is charged. Any unused part of a free trial is forfeited when you buy a Subscription.
Managing and cancelling. You can manage or cancel your Subscription at any time in your Apple ID settings (Settings > [your name] > Subscriptions). Cancellation takes effect at the end of the current billing period, and you keep Premium until then. Deleting the App or your data does not cancel a Subscription.
Refunds. Apple processes all App Store payments and handles refund requests, including any statutory right of withdrawal you may have, under its terms and applicable law. We cannot issue refunds for App Store purchases. You can request a refund at reportaproblem.apple.com.

7. Licence

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use the App on Devices that you own or control, for your personal, non-commercial use and as permitted by the Usage Rules of the Apple Media Services Terms and Conditions.

You may not:

copy, modify, translate, reverse engineer, decompile or disassemble the App, or extract VPN configurations, keys or credentials from it, except where the law expressly allows;
rent, lend, sell, redistribute, sublicense or otherwise commercially exploit the App or the Service;
remove or change any proprietary notices in the App; or
use the App or the Service in any way not permitted by these Terms.

8. Acceptable Use

You agree to use the Service lawfully and in line with these Terms. You must not use the Service, or allow anyone else to use it, to:

engage in, facilitate or promote any activity that is illegal under any law that applies to you;
gain or attempt to gain unauthorized access to any system, network, account or data, or carry out port scanning, vulnerability scanning, denial-of-service attacks or any other network attack;
send or store malware or other harmful code;
send spam or bulk unsolicited messages, or carry out phishing or other fraud;
infringe intellectual property rights, including by distributing pirated material;
create, access, store or distribute child sexual abuse material or any content that sexualizes or exploits minors;
harass, threaten, defame or harm others, or violate their privacy;
commit fraud, launder money or finance illegal activity;
share, resell or give others access to your Account, Subscription or VPN connection, or operate the Service for third parties;
run automated or excessive traffic that harms the Service or other users, or interfere with our servers or network; or
get around the Free Version's limits, our security measures or any other restriction, for example by manipulating device identifiers or the App.

9. Fair Use and Enforcement

To keep the Service available and secure for everyone, we use connection records and automated checks, as described in the Privacy Policy, to detect abuse, such as an Account or connection being used from many networks at the same time, or traffic that harms our servers. If we reasonably believe that you have broken these Terms or the law, or that your use threatens the Service or other users, we may limit your connection speed, end active sessions, or suspend or terminate your access, with or without notice. If an automated check has restricted your access, you can contact us and ask for a person to review it.

10. Privacy

Our Privacy Policy explains what data we and our service providers process. In summary: we do not log the websites you visit, the destinations you connect to, your DNS queries or the content of your traffic. We do keep connection records, such as connection times, the server and protocol used, data volumes and the approximate country and network operator you connected from, for 90 days, along with running totals for your Account. We use them to run, secure and improve the Service.

11. Notifications and Feedback

If you allow notifications, we may send you service messages and promotional messages. You can turn them off at any time in iOS Settings.

If you rate a connection, report a problem or send us suggestions, you allow us to use that feedback to improve the Service without any obligation to you.

12. Compliance with Local Laws

VPN use is regulated, restricted or prohibited in some countries, and the legality of accessing particular content or services through a VPN varies by location.

You are solely responsible for making sure that your use of the App and the Service is lawful where you are, and that it complies with all applicable laws and the terms of any network you use. We do not give legal advice, and nothing in the App or these Terms means that using the Service is lawful in any particular place. To the maximum extent permitted by law, we are not responsible for any consequence of your use of the Service in breach of any law, regulation or third-party terms.

13. Intellectual Property

The App, the Service and all related software, content, designs, trademarks and logos belong to Esinti or its licensors and are protected by law. Apart from the licence in Section 7, you receive no rights in them. "Presto", "Presto VPN" and the related names and logos are trademarks or trade names of Esinti and may not be used without our prior written permission.

14. Third-Party Services and Content

Through the Service you can access websites, content and services operated by third parties. We do not control them and are not responsible for their availability, accuracy, legality or safety. Your use of them is at your own risk and may be subject to their own terms.

The App also includes third-party software and services, such as those provided by Apple, Google (Firebase and AdMob), AppsFlyer and Adapty. Their terms and privacy practices apply to their components, as described in our Privacy Policy.

15. Disclaimer of Warranties

To the maximum extent permitted by law, the App and the Service are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

In particular, we do not warrant that:

the Service will be uninterrupted, secure, timely or error-free;
the Service will connect or work in any particular country, on any particular network or at any particular time;
all of your traffic will always be routed through the VPN;
any defects will be corrected; or
the Service will meet your requirements or expectations.

Some jurisdictions do not allow certain warranties to be excluded, so some of these exclusions may not apply to you.

16. Limitation of Liability

To the maximum extent permitted by law:

Esinti, its directors, employees and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising from or relating to your use of, or inability to use, the App or the Service; and
our total liability arising from or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid for the App and Subscriptions in the 12 months before the event giving rise to the liability, or (b) the equivalent of USD 50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including your mandatory rights as a consumer.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Esinti and its directors, employees and service providers against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising from your breach of these Terms, your breach of any law or the rights of a third party, or your misuse of the Service.

18. Suspension and Termination

We may suspend or terminate your access to the Service as described in Section 9.

You can stop using the Service at any time by uninstalling the App. Uninstalling does not cancel a Subscription or delete your data; see Section 6 and our Privacy Policy.

Provisions that by their nature should survive termination, including those on intellectual property, disclaimers, limitation of liability, indemnification and governing law, will survive.

19. Changes to the Service and these Terms

We may change the Service and these Terms from time to time. If a change to these Terms is material, we will take reasonable steps to tell you in advance, for example in the App, and we will update the "Last updated" date above. If you keep using the App after the changes take effect, you accept the updated Terms. If you do not agree, you must stop using the App and cancel any Subscription.

20. Apple App Store: Additional Terms

These Terms are between you and Esinti only, not Apple Inc. ("Apple"). For the App obtained from the Apple App Store:

Apple has no obligation to provide maintenance or support for the App.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
Apple is not responsible for any claims by you or any third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
If a third party claims that the App or your possession and use of it infringes their intellectual property rights, Esinti, not Apple, will be responsible for the investigation, defence, settlement and discharge of that claim, to the extent required by these Terms.
You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms when using the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple may enforce these Terms against you as a third-party beneficiary.

21. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. Subject to any mandatory consumer protection rights you have under the laws of your country of residence, the courts of Istanbul, Türkiye have jurisdiction over any dispute arising from or relating to these Terms or the Service.

22. General

Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and Esinti about the App and the Service.
Severability. If any provision is held invalid or unenforceable, the rest of these Terms remains in force.
No waiver. If we do not enforce a provision, we do not waive our right to enforce it later.
Assignment. You may not assign or transfer these Terms. We may assign them as part of a merger, acquisition or sale of assets.
Language. These Terms are written in English. If we provide a translation, the English version prevails to the extent permitted by law.
